Outbound System Inc. provides high-touch, custom lead generation infrastructure. Unlike a software subscription (SaaS), our service involves immediate, intensive manual labor, strategic ICP development, and the procurement of non-transferable third-party technology licenses on your behalf. Because 100% of our service delivery is front-loaded to ensure campaign success, we do not offer "trial periods" or "money-back guarantees." By engaging our firm, you acknowledge that professional resources are committed to your account the moment payment is processed.
Binding Nature of Agreement and Non-Refundability
This Refund and Cancellation Policy is incorporated by reference into the Master Services Agreement (MSA) and any active Statement of Work (SOW) executed between the Parties. Pursuant to MSA Section 4.1 and SOW Section 2.1, the Customer acknowledges and agrees that all fees, including Initial Setup Fees and Management Fees, are strictly non-refundable under any circumstances. The Customer explicitly waives any right to a refund, credit, once the Service Start Date has occurred.
Service Commencement and Earned Fees
The Customer acknowledges that Outbound System Inc. immediately commences service delivery upon the submission of the completed onboarding questionnaire. This "Service Start Date" triggers the immediate allocation of professional resources, including account manager assignment, market research, and campaign strategy formulation. Consequently, all payments are considered fully earned upon receipt in consideration of the labor and administrative costs initiated at the time of purchase.
Immediate Merchant Loss (The "Hard Cost" Rule)
To facilitate these professional services, Outbound System Inc. must immediately prepay third-party technology vendors for non-transferable software licenses and outreach infrastructure. Because these are non-recoupable hard costs that cannot be recovered from our suppliers, the Merchant cannot issue refunds without incurring a direct financial loss. Any attempt to seek a refund for these prepaid obligations constitutes a breach of the economic intent of the Agreement.
Performance Standards and Satisfaction
Outbound System Inc. warrants that services shall be performed in a professional manner in accordance with prevailing industry standards. However, because lead generation outcomes are influenced by external market forces and the quality of the Customer’s specific offer, we do not guarantee sales or other lead generation outcomes. Per MSA Section 4.7, dissatisfaction with campaign results or messaging style does not constitute a valid ground for a refund or a credit.
Termination of Renewals vs. Trial Periods
The "10-day notice" provision set forth in SOW Section 1 is strictly for the termination of future automatic renewals. To forego an upcoming renewal, the Customer must provide written notice at least ten (10) days prior to the end of the current term. This notice period is not a "money-back guarantee" or a "trial period," and does not entitle the Customer to a refund for fees already paid for a term in progress.
